“Buyer”: This means the person/s buying the Goods as specified in any invoice, document or order

“Goods”: This means all Goods or Services supplied by the Seller to the Buyer at the Buyer’s request from time to time

2. Accuracy of Information

We attempt to be as accurate as possible when describing our products; however, to the extent permitted by applicable law, we do not warrant that the product descriptions, colours, information or other content available are accurate, complete, reliable, current, or error-free.

This Site and its components are offered for informational purposes only; this site shall not be responsible or liable for the accuracy, usefulness or availability of any information transmitted or made available via the site, and shall not be responsible or liable for any error or omissions in that information

3. Intellectual Property

The Site and its original content, features, and functionality are owned by BG Precision PTY LTD and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

4. Changes to this Agreement

BG Precision PTY LTD reserves the right to modify these Terms of Service at any time. We do so by posting and drawing attention to the updated terms on the Site. Your decision to continue to visit and make use of the Site after such changes have been made constitutes your formal acceptance of the new Terms of Service.

Therefore, we ask that you check and review this Agreement for such changes on an occasional basis. Should you not agree to any provision of this Agreement or any changes we make to this Agreement, we ask and advise that you do not use or continue to access the Site immediately.

5. Payments and Refunds Policy

Please review our Payments and Refunds Policy so that you may understand our  acceptable methods of payment, how those payments will be processed and how the return/refund process works.

6. Delivery of Goods

BG Precision will make every effort to ensure your purchase is delivered within 5 to 10 working days to the address specified during the purchase process. For WA, Far North QLD, NT, and remote country areas please allow an extra 2-3 days for delivery.

Upon successful completion of your order, we will provide you with a confirmation email containing details of your order.

BG Precision uses Australia post for all small parcel delivers. Please see HERE for Australia Post’s General Terms & Conditions.

For large orders such as CNC Machines and Heavy Goods freight will be confirmed upon order confirmation. To obtain a quote for machine deliver please contact us directly. Click HERE to view our contact details. The Buyer shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery. In the event that the Buyer is unable to take delivery of the Goods as arranged then the Seller shall be entitled to charge a reasonable fee for re-delivery.

Orders are processed for delivery on working days only (Monday through Friday, excluding public holidays).

Orders placed on Friday, Saturday, Sunday and Public Holidays will be confirmed within the next 2 business days.

We will take all reasonable care to deliver to the address given. However, we will not be liable for non-delivery or miss-delivery as a result of incorrect data entry.

We accept orders to P.O Box addresses.

Once your order is placed, it is too late.  However if you contact us as soon as reasonably possible we will do our best to cater for your needs.

7. Product(s)

All Products supplied by the BG Precision to the Buyer shall be deemed to operate satisfactorily if the Goods operate in accordance with the relevant specifications of the manufacturer of the Goods.

The Buyer acknowledges that the ability of the product to operate satisfactorily in accordance with their specifications is dependent upon the proper layout and maintenance of the Goods for which the Buyer is responsible.

Neither the Seller nor the manufacturer accepts any responsibility or liability whatsoever should the colour, designs or dimensions of the Goods vary from the colour, designs or dimensions contained in any product catalogue, brochure or other promotional or information document in respect of the Goods.

8.  Defects, Warranties and Returns.

The Buyer must inspect the Goods on delivery and must within seven (7) days of delivery notify the Seller in writing of any evident defect/damage, shortage in quantity, or failure to comply with the description or quote. The Buyer must notify any other alleged defect in the Goods as soon as reasonably possible after any such defect becomes evident. Upon such notification the Buyer must allow the Seller to inspect the Goods.

The Seller acknowledges that nothing in these terms and conditions purports to modify or exclude the Non-Excluded Guarantees.

BG Precision’s liability for any defect or damage in the Goods is:

(a) limited to the value of any express warranty or warranty card provided to the Buyer by BG Precision.

(b) limited to any warranty to which the BG Precision is entitled, if the BG Precision did not manufacture the Goods

Subject to this clause, returns will only be accepted provided that:

(a) the Buyer has complied with the provisions this clause
and
(b) the Seller has agreed that the Goods are defective
and
(c) the Goods are returned within a reasonable time at the Buyer’s cost (if that cost is not significant)
and
(d) the Goods are returned in as close a condition to that in which they were delivered as is possible.

BG Precision shall not be liable for any defect or damage which may be caused or partly caused by or arise as a result of:
(a) the Buyer failing to properly maintain or store any Goods

(b) the Buyer using the Goods for any purpose other than that for which they were designed

(c) the Buyer continuing the use of any Goods after any defect became apparent or should have become apparent to a reasonably prudent operator or user

(d) the Buyer failing to follow any instructions or guidelines provided by the Seller

(e) fair wear and tear, any accident, or act of God.
